Cold Hearted Bastards
The Judiciary & Civil Jurisprudence Committee chaired by Representative Todd Hunter held a hearing on arbitration and the overwhelming majority of the testimony was directed at the Texas homebuilding industry, once again depicting them as cold hearted, cruel, bastards. Just as they have been depicted over the last 10 years at every single hearing on the abuse of mandatory binding arbitration.
It hasn't changed in 10 years and our elected officials have done nothing.
Whores of the Industry
There were a number of individuals who were arbitrators, or worked for the arbitration industry or in some way, made money off of homeowners, who testified how homeowners were better off without the protection of the 7th amendment of the Constitution of the United States. Their testimony was tainted since they were whores to the industry. Here are the words of the Constitution they crap on:
In suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury, shall be otherwise re-examined in any Court of the United States, than according to the rules of the common law.Homebuilder Attorneys
And there were the homebuilders and their attorneys attempting to rationalize why homeowners are better off without the protection of the 7th amendment and snickering when homeowners were crying during their testimony. Not one single homeowner testified in favor of arbitration over the last 10 years. Not one single consumer group testified in favor over the last 10 years. Only those who benefit from arbitration spoke in favor of forcing homeowners into it as a prerequisite to buying a home.
It's not a mistake.
Make no mistake about this hearing or any hearing over the last 10 years. It was about the abuse of the home building industry of mandatory binding arbitration. The home building industry was kicked in the nuts for over 4 hours prompting the lead counsel of the Texas Association of Builders to say "My industry has taken a hit today". No shit sherlock! Are you that dense? Are you that stupid? Are you that immoral? Do you need to go to church Einstein?
To his credit, Representative Hunter has called for a working group to work on this issue. Let's hope it is not stacked against the consumer and it is focused on stopping the use of mandatory binding arbitration in new home contracts.
